1. Acceptance of Terms

Welcome to VerbPal! By accessing or using our mobile application and website (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use our Service.

These Terms constitute a legally binding agreement between you and Abbika LLC ("VerbPal," "we," "us," or "our").

2. Description of Service

VerbPal is a language learning application that helps users master verb conjugations through:

• Spaced repetition learning using the SM-2 algorithm
• Interactive exercises and drills
• Progress tracking and streak systems
• Support for multiple languages including Spanish, French, Portuguese, German, Italian, Polish, Romanian, Dutch, Ukrainian, and English

The Service is available on iOS, Android, and web platforms.

3. Account Registration

To access certain features of VerbPal, you must create an account. You agree to:

• Provide accurate, current, and complete information
• Maintain and update your information as necessary
• Keep your password secure and confidential
• Be responsible for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 13 years old to create an account. If you are under 18, you represent that your parent or guardian has reviewed and agreed to these Terms.

4. Subscriptions and Payments

Free and Premium Features

VerbPal offers both free features and premium subscription plans. Premium subscriptions provide access to additional content and features.

Billing

• Subscription fees are billed in advance on a recurring basis (monthly or annually)
• Payments are processed through the Apple App Store, Google Play Store, or RevenueCat
• Prices may vary by region and are displayed in your local currency

Cancellation

• You may cancel your subscription at any time through your device's app store settings
• Cancellation takes effect at the end of the current billing period
• No refunds are provided for partial billing periods

Free Trials

We may offer free trial periods. Unless you cancel before the trial ends, you will be automatically charged for a subscription.

5. User Conduct

You agree NOT to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to our systems
• Interfere with or disrupt the Service
• Copy, modify, or distribute our content without permission
• Use automated means to access the Service (bots, scrapers, etc.)
• Impersonate any person or entity
• Share your account credentials with others
• Circumvent any access restrictions or usage limits

6. Intellectual Property

Our Content

VerbPal and its content, including but not limited to text, graphics, logos, the Lexi mascot, audio, exercises, and software, are owned by Abbika LLC and protected by intellectual property laws. You may not use our content without our express written permission.

Your Content

Any feedback, suggestions, or ideas you provide to us may be used by VerbPal without compensation or attribution to you.

7. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not guarantee that:

• The Service will be uninterrupted or error-free
• Defects will be corrected
• The Service is free of viruses or harmful components
• You will achieve any particular learning outcomes

8. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, ABBIKA LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR USE, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

In no event shall our total liability exceed the amount you paid us in the twelve (12) months prior to the claim, or $100, whichever is greater.

9. Indemnification

You agree to indemnify and hold harmless Abbika LLC and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your use of the Service or violation of these Terms.

10. Termination

We may suspend or terminate your account at any time for any reason, including breach of these Terms. Upon termination:

• Your right to use the Service immediately ceases
• We may delete your account data (subject to our Privacy Policy)
• Provisions that should survive termination will remain in effect

You may terminate your account at any time by contacting us or through the app settings.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law provisions. Any disputes arising from these Terms shall be resolved in the appropriate courts of the United States.

12. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms and updating the "Last updated" date. Your continued use of the Service after changes constitutes acceptance of the new Terms.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.
